Skilled Independent visa (subclass 189)

The 189 visa is the primary category of skilled migration visa. A successful application grants permanent residency, allowing individuals to freely enter, live, and work in Australia.

Every year, the Department of Home Affairs determines or revises the Medium and Long-Term Strategic Skills List (MLTSSL) based on the actual needs of the Australian labor market. This process involves considering recommendations from unions, industry associations, and educational institutions.

Occupations listed on the MLTSSL are eligible for the Independent Skilled Migration if they meet the following relevant criteria:

  • Under the age of 45
  • Achieve a minimum score of 6 in each component of the IELTS
  • Successfully complete a skills assessment specific to the nominated occupation.
  • Attain a minimum of 65 points on the immigration points test, which takes into account factors such as age, English proficiency, work experience, education, and other criteria.
  • Meet the health and character requirements specified by the Department of Home Affairs.

The 189 visa does not consider the applicant’s educational background and work experience, whether obtained within or outside Australia. As long as the individual possesses the skills that are in demand in the Australian labor market, they are eligible for this visa category.

Let’s take the example of civil engineers:

Student A has a bachelor’s degree in civil engineering from Australia, is 25 years old at graduation, and has an IELTS score of 7 in each component. This type of student is an ideal candidate for the 189 visa, as they can apply for permanent residency immediately after graduation.

Student B has a bachelor’s degree in civil engineering from China, is currently 25 years old, has an IELTS score of 7 in each component, and has three years of relevant experience in civil engineering. This type of student is an ideal candidate for offshore application of the 189 visa.

Both of the above scenarios are considered ideal, but in reality, many students may not meet the age requirements, achieve the desired IELTS scores, or have work experience that qualifies for additional points.
