300 Fiance Visa

Spouse immigration (partner migration), as the name implies, is a permanent residence visa issued to Australian citizens, permanent residents and spouses of eligible New Zealand citizens. In Australia, it is the family immigration with the highest priority after minor children immigration. The government does not set a quota for this type of visa, so applicants do not have to wait in line. Even so, spouse immigration is the most complicated type of family immigration. Petitioners can include married couples or de facto spouses or even same-sex spouses.

Who can be a guarantor:

  • Australian citizens over the age of 18
  • Australian permanent residents aged 18 or over
  • Eligible New Zealand citizens aged 18 or over
  • Has not sponsored a spouse within five years to apply for spouse immigration

Type of visa

  • Fiancee visa (subclass 300)

The length of the visa is 9 months. The applicant needs to arrive in Australia within 9 months and marry the guarantor, and then submit the spouse visa 820/801 in Australia.

  • Onshore spouse visa (subclass 820/801)

Precautions for 300 visa

1. If you submitted a 300 visa application, but you were married before the visa was issued, you can apply to the Immigration Bureau for a spouse visa without re-paying the application fee;
2. After the visa is issued, you can go abroad or get married in the country, but the applicant must guarantee that he has landed in Australia with a 300 visa at least once before getting married;
3. After obtaining the visa, if the applicant does not go to Australia to marry his spouse within the validity period of 9 months, the visa will be cancelled; or the applicant enters the country but does not marry his spouse, he will be deported;
4. In most cases, within the specified period, if you enter the country but marry someone other than your spouse, your visa will also be cancelled, and you will also be deported;
5. Inform the Immigration Bureau in time of changes in address or other circumstances, such as pregnancy, divorce, etc.
6. If you are married before your visa is issued, you need to notify the Immigration Department so that you can change your visa;
